LeadingAge and Hospice Advocates Meet with OMB and DEA on Final Teleprescribing Rule
On September 25, LeadingAge organized and led a meeting with the Office of Management and Budget (OMB) and other hospice advocates including the American Academy of Hospice and Palliative Care, the National Alliance for Care at Home, and the National Partnership for Hospice and Healthcare Innovation, to discuss the pending Drug Enforcement Administration's (DEA) final rule on e-prescribing. This rule would require providers e-prescribing controlled substances to meet certain new regulatory requirements. With OMB and DEA, LeadingAge and colleagues advocated for creating an exemption for hospice providers to the regulations as the immediate access to controlled substances, specifically schedule II, is imperative to patients at the end of life and restricting access could significantly impact overall healthcare expenses as patients seek these drugs through ER visits and hospital admissions. The government staff present on the call did not ask any questions on the call, which is typical of meetings with OMB at this point in the rulemaking cycle. The anticipated release of this rule is November 2026. As we know more, we will inform members.
New CMS Training on Hospice Quality Data Submission and Provider Reports.
\On September 24, the Centers for Medicare & Medicaid Services (CMS) released a second part of a two-part series on the Hospice Quality Reporting Program (HQRP) data submission requirements and reports. This training provides guidance on HOPE data submission and related iQIES provider reports.
CMS Updates FY2027 Hospice Payment After Technical Errors.
In September, the Centers for Medicare and Medicaid Services (CMS) alerted providers that a technical error in the final Fiscal Year (FY) 2027 hospice wage index affected FY27 hospice wage index values for all census-based statistical areas (CBSAs) and rural areas. On September 29, CMS published to the Federal Register corrections to the FY2027 Hospice Wage Index Final rule that updates the wage index standardization factors, and, subsequently, the national payment rates for each level of hospice care.
Transparency Win: CMS Directs MACs to Publish Quarterly Data on TPE.
In a Change Request (CR 14616) published on September 30, 2026, the Centers for Medicare and Medicaid Services (CMS) directs Medicare Administrative Contractors (MACs) to post Target Probe and Educate (TPE) results quarterly on their websites. This is a big win for home health, hospice, and nursing home providers who, until now, had no insights into trends and issues concerning TPE. LeadingAge has repeatedly called for this kind of transparency from MACs, most recently in our response to the Comprehensive Regulations to Uncover Suspicious Healthcare (CRUSH) Request for Information. The changes CMS is requiring will take effect November 2, 2026. CMS states that, at a minimum, MACs must post the three most common reasons per Targeted Probe and Educate prioritized problem on their websites. Additionally, if more than three denial reasons for a specific topic would be useful, the MACs should include those as well. This information will go a long way towards educating the greater provider community regarding what payment processing issues and trends.
Home Health Provider Preview Reports for January 2027 Refresh.
The Home Health Provider Preview Reports are now available to providers on iQIES. These reports contain provider performance scores for quality measures, which will be
published on the compare tool on Medicare.gov and the Provider Data Catalog (PDC) during the January 2027 refresh. This includes updates to home health CAHPS, star ratings, and OASIS measures. Claims-based measures will be publicly reported in the October 2026 care compare refresh.
