LeadingAge Meets with Center for Medicaid and CHIP Services (CMCS) Staff

On December 5, LeadingAge along with partners met with staff from CMCS. Topics discussed at the meeting included the Medicaid Access Rule’s 80/20 requirement and HR 1's community engagement requirement (aka work requirement). With regards to the Access Rule, LeadingAge continued to underscore the need to eliminate the 80/20 rule and associated reporting requirements. CMS said they will be able to discuss more about their intentions around the future of this requirement soon. With regards to community engagement, CMS had a number of questions around the operationalization of the community engagement requirement exemptions and welcomed additional feedback in the coming weeks. LeadingAge will continue engagement with CMS on both Medicaid deregulatory priorities and the implementation of HR 1.

CMS Permitting More Services to be Offered Outpatient CMS has proposed its Calendar Year 2027 Outpatient Prospective Payment System rule to continue to phase out procedures and services from the Inpatient Only List. These are services/procedures that previously could only be provided on an inpatient hospital basis. These changes have potential impacts on Skilled Nursing Facility and Home Health agency admissions.
