Nebraska Department of Health and Human Services Public Notice

DHHS is seeking approval of a five-year waiver to limit retroactive Medicaid eligibility for the full Medicaid population. This initiative, the Sustainable Coverage Demonstration, seeks to align coverage more closely with the time of application to support timely enrollment, promote continuity of coverage, and strengthen the state's ability to focus resources on the most vulnerable Nebraskans who rely on Medicaid for essential care. DHHS and the Nebraska Division of Medicaid and Long-Term Care (MLTC) administer the Nebraska Medicaid program and are responsible for the implementation of this Medicaid Demonstration project.  To view the full public notice, please visit the following link: Nebraska Medicaid Section 1115 Sustainable Coverage Demonstration​ 

 

Overall, the proposal does not address processing delays and does not reflect long term care spend down realities. We ask that you provide comment on this rule change prior to the deadline of March 26, 2026.

LB867 (Health and Human Services Committee)

  • This bill changes and eliminates programs involving special need trusts, spousal impoverishment, child support customer service, child care grants, AABD (aged, blind and disabled), the state Commodity Supplemental Food program, and others. It specifically eliminates the designation of assets for or use of income by an individual in accordance with section 68-922 to be considered just cause for failure to use such assets or income to provide medical support of such individual’s spouse and eliminates the ability to establish a pooled special needs trust. In addition, this bill changes provisions relating to fingerprints in compacts, and tribal age of majority provisions in the Bridge to Independence Program, and eliminates obsolete provisions relating to the Nursing Compact.
